Update: GreenGEN contact with landowners

We understand that GreenGEN has begun contacting landowners along the proposed Towy–Usk, Towy–Teifi and Vyrnwy–Frankton connection projects.
We are aware that GreenGEN and its representatives are issuing different forms of correspondence, and we want to make sure people are clear about the position.
Changes of route
Many landowners have received letters suggesting that their land is no longer required because of a change of route. Landowners on newly proposed routes have also been contacted.
Our position remains one of caution.
This is not the first time GreenGEN has altered its proposed routes, and routes may change again. For that reason, we strongly encourage those affected to remain engaged, so they stay informed and protected should proposals revert to previous alignments or shift again.
Informal contact and survey requests
Under GreenGEN’s new internal policies, they are required to make several attempts to contact landowners before issuing a statutory notice.
At this stage, people are not required to respond to general or informal correspondence.
If you receive a phone call, you should make clear that communications should be directed to your legal representatives, New South Law.
If you receive any contact from GreenGEN or its representatives, it is important to forward it on promptly so that advice can be given on the next steps.We are aware of statutory Notices having been affixed to land by GreenGEN over the past 2-3 weeks. Please note that, as per our earlier messages, GreenGEN's survey powers are currently heavily constrained by Order of the High Court. We do not believe that the Notices posted to land comply with the Court Order. We are also aware of LiDAR (fixed wing / aeroplane) surveys which are also unlikely to comply. The legal team are currently addressing this and we will let you know more as soon as we are able
We expect formal statutory notices to begin being issued in the coming days and weeks. Further guidance will follow as matters develop.
What a statutory notice may include
A statutory notice will typically include:
A legal notice letter referring to sections 172 and 174 of the Housing and Planning Act 2016
A schedule listing proposed surveys
A map showing the land GreenGEN seeks to survey
A proposed licence
A schedule of activities and hand-held equipment
Supporting information documents, such as environmental or engineering survey leaflets

If you are contacted, do not agree to access, sign any documents, or enter into discussions about surveys or land rights without first taking legal advice.
Please notify New South Law immediately and forward any correspondence you receive.
If you have had a section 174 notice placed on land by GreenGEN or its agents, or if surveyors have taken entry, New South Law has asked that the following be sent in as soon as possible:
A copy of the notice, including any attached map and survey schedule or tables
Any photographs or videos of surveyors, GreenGEN or their contractors on the land, together with the date taken
Any photographs or videos of equipment left on site, together with the date taken
A pin, What3Words reference, coordinates, a marked map, or a clear description showing the location

Why this matters
Evidence from the ground continues to matter.
The community approach being taken, alongside the legal proceedings, is making a difference. Where there is evidence of non-compliance by GreenGEN, it is important that it is gathered and passed on so it can be considered and, where appropriate, used in the court proceedings.
Next steps
Developments are being monitored closely and further advice will be issued as matters progress.
Instructions for clients who receive notices or survey requests are also being prepared and will be circulated once the first of those documents begin to arrive.
